Legal Brief: When we claim compensation from the insurer through legal channels, until now, the injured party had to cover the cost of a medical expert's evaluation to quantify the damage. However, a recent ruling by the Provincial Court of Las Palmas indicates that compensation can be claimed with just the emergency report and the discharge summary, particularly when there is also a work-related sick leave. This is because temporary injuries can be quantified based on medical documentation that allows for assessing personal injury without the need for an expert report. In fact, in amicable settlements, insurers make offers based on this documentation.
