LEGAL COMMON PROPERTIES DO NOT PREVENT FROM COMPENSATION OF PRIVATE MONEY INVESTED

The Supreme Court (TS) has recognized the right of a divorced man to recover part of the money from a personal compensation he received after a traffic accident, which he invested in the purchase of an apartment, a garage, and a car that he enjoyed with his wife while their marriage, under a community property regime, was in effect. This is a sum of private money he received as compensation for the traffic accident. According to the Supreme Court's own doctrine, attributing the community property status to the asset does not convert the money used for its acquisition into community property. In general, the high court also acknowledges the right to reimbursement of the money invested in the acquisition of a community property asset, even if no reservation of private money was made at the time of the asset's purchase.
